In my experience and that of my associates at WSR Consulting Group -- experience that covers more than 75 litigation matters involving software and IT project failure -- the same themes, allegations, and defenses appear time and time again (see Figure 1). Depending on the specific facts, some arguments are persuasive, while others are red herrings.
