A Tale of Two Privacies: Protection for Private Consumer Information Under US and EU Law
The novel A Tale of Two Cities 1 begins with the oft-quoted line, "It was the best of times, it was the worst of times...." Although these words were written to describe the situation prior to the French Revolution, the same words could apply with equal force to the situation consumers face today with respect to protection of their private information. Many consumers are having "the best of times" capitalizing on the information and activities available to them via the Internet; yet by sharing their data (or having it captured) online, they risk "the worst of times" from a consumer's perspective -- junk mail, spam, and perhaps even identity theft.
