An On-Demand Webinar Exclusively for Cutter Clients

Ed Yourdon
Planning For, and Coping With, IT Litigation Risks
Presenter: Ed Yourdon, Fellow, Cutter Business Technology Council

From projects that are behind schedule and over budget to ever-increasing outsourcing, it's more important than ever for IT organizations to formulate a proactive strategy to protect their IP and ensure that their outsourcing contracts won't degenerate into a litigious confrontation. In this hour-long webinar, Ed Yourdon will explore the litigation-related trends we are likely to face over the next several years and offer proven strategies for dealing with litigation -- both before and after a lawsuit is filed.

Ed Yourdon has seen and participated in IT litigation from every side of the table: He's worked with IT organizations and companies such as systems integrators, outsourcing firms, software product companies, etc. on a strategic basis to reduce/minimize litigation risks; he's worked with project teams at the beginning of their project to see where they might be vulnerable to litigation risks; and he's worked as an expert witness in cases where IT litigation risk management was absent or failed. What has Ed discovered through all his litigation-support work? Most failures involve nothing more than "Project Management 101."

For the first 40 minutes of this webinar, Ed will divulge real-world case studies, lessons learned and best practices for minimizing IT litigation risk, as well as strategies for coping with litigation, should your organization end up there. Armed with the information and practical advice you'll glean from this webinar, you'll be better able to reduce the chances of your next IT project resulting in an expensive lawsuit, increase your projects chance of succeeding in the first place, and make your software-related IP even safer than it was before.

Spend an hour with Ed Yourdon and discover the common litigation risks associated with IT projects, learn how to identify and remove the landmines in your contracts, and get practical strategies for minimizing and managing IT-litigation risks.

IT-Related Litigation: Likely Trends and Recommended Practices

Cutter IT Journal, Vol. 18 No. 11

The legal ramifications of IT seem to be a perennially new topic, perhaps because most IT professionals would prefer not to think about such things. Alas, an embarrassingly large percentage of IT projects continue to fail -- and now that so many system development/integration projects involve outsourcing contracts between vendors and customers who may be located on opposite sides of the world, the failures are even more likely to result in expensive litigation.

In addition, the issue of software-based intellectual property (IP) has become increasingly important in recent years, and companies have become ever more vigilant in pursuing and defending their software patents, trade secrets, copyrights, and other forms of IP. This, too, has become a more complex topic in recent years -- partly because of the open source phenomenon and partly because developing nations and political blocs have perspectives and priorities that are sometimes at odds with the policies and positions of the US, Canada, the UK, and other traditional sources of IP.

Thus, Cutter IT Journal Editor Emeritus Ed Yourdon assembled a team of lawyers, expert witnesses, and technology experts to examine some of the issues and trends in this area. Here, you can find out what they have to say.
